Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") are an agreement between SculptFlow LLC ("SculptFlow," "we," "us") and the clinic or business entity that creates an account or otherwise uses SculptFlow's website, software or related services (the "Service," "you," "your"). By accessing mysculptflow.com or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

If you're using the Service on behalf of a clinic or company, you confirm you have authority to bind that organization to these Terms.

2. The service

SculptFlow is a communication, lead management and automation platform for plastic surgery and aesthetic clinics. It helps clinics connect messaging channels (such as WhatsApp, Instagram and Facebook Messenger), manage conversations from a unified inbox, organize leads, schedule consultations, run communication campaigns, and automate repetitive workflows.

We may add, change or remove features over time. This site itself is informational; functionality described here (inbox, automation, dashboard and similar) is part of the software product, which is governed by these Terms once you have an active account.

3. Accounts

• You're responsible for keeping your account credentials secure and for all activity under your account.
• You must provide accurate information when creating an account and keep it up to date.
• You're responsible for the conduct of staff members you grant access to your account.

4. Acceptable use

You agree not to use the Service to:

• Send unsolicited messages in violation of applicable messaging or anti-spam laws, or the terms of the channels you connect (WhatsApp, Instagram, Messenger and any others);
• Collect or process personal data unlawfully, or in a way that violates the rights of the people you contact;
• Misrepresent your clinic's identity or credentials to leads or patients;
• Interfere with or disrupt the integrity or performance of the Service;
• Attempt to gain unauthorized access to the Service or other users' data.

5. Clinic & lead data

You retain ownership of the conversation, lead and contact data you and your leads generate through the Service ("Clinic Data"). You grant SculptFlow the right to process Clinic Data solely to provide, maintain and improve the Service.

You are responsible for having a lawful basis to collect and share the contact information and messages of your leads and patients through the Service, and for your own compliance with data protection and patient-privacy laws that apply to your clinic.

Clinic Data is hosted using Supabase, on Amazon Web Services (AWS) infrastructure in the Asia Pacific (Tokyo, Japan) region, with encryption in transit and at rest. We retain Clinic Data for as long as your account remains open; if you close your account, we will delete your Clinic Data upon request, which you can make by contacting support@mysculptflow.com.

6. Automation & AI features

The Service includes automation and AI-assisted features that can help draft replies, qualify leads and manage follow-up. These features are designed to assist your staff, not replace them: your team can view any conversation, reply manually at any time, take over from automation, and return a conversation to automation afterward.

You're responsible for reviewing automated communications sent on your clinic's behalf and for configuring the Service in line with your own policies and applicable law.

7. No medical advice

SculptFlow is a communication, lead management, scheduling and automation platform. It does not provide medical advice, diagnoses or treatment recommendations, and nothing in the Service should be treated as such. Medical decisions remain solely the responsibility of your clinic and its licensed professionals.

8. Fees & billing

Certain features of SculptFlow may be offered on a paid subscription basis. All fees are stated and charged in U.S. dollars (USD) unless otherwise specified. Current subscription prices, billing intervals, included features, usage limits, and any applicable additional charges will be displayed on our website or during the checkout process before you purchase a paid plan.

By subscribing to a paid plan, you authorize SculptFlow and its payment processor to charge the applicable subscription fees and taxes to your selected payment method. Subscriptions may renew automatically at the end of each billing period unless canceled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting our support team. Unless otherwise required by applicable law, amounts already paid are non-refundable, and cancellation will take effect at the end of the current billing period.

SculptFlow may change its pricing, introduce new plans, or modify features included in existing plans. Where required, we will provide reasonable notice before pricing changes apply to an existing subscription.

Certain third-party services integrated with SculptFlow, including messaging platforms, telecommunications providers, AI services, or other external providers, may impose separate usage or service fees. Any such charges will be disclosed where applicable.

9. Intellectual property

SculptFlow and its licensors own all rights, title and interest in the Service, including its software, design and branding. These Terms don't grant you any rights to SculptFlow's trademarks or branding beyond what's needed to use the Service as intended.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms and don't correct the breach after being notified, or where required by law. On termination, your right to use the Service ends, though provisions that by their nature should survive (such as data handling obligations and limitations of liability) will continue to apply.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, SculptFlow disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that any particular business outcome (such as a number of consultations or conversions) will result from using it.

12. Limitation of liability

To the fullest extent permitted by law, SculptFlow will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, arising from your use of the Service.

13. Governing law

These Terms are governed by the laws of Lebanon, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Beirut, Lebanon.

14. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify account holders. Continued use of the Service after changes take effect means you accept the updated Terms.
